Marketplace Terms of Use
1. Provider and scope
(1) The REPAIRCON26 marketplace (the “Marketplace”) is operated by morecon GmbH, Friedrichstraße 3, 69412 Eberbach, Germany, the organizer of REPAIRCON (“we” or “us”).
(2) These Terms apply to everyone who submits offers or wanted listings on the Marketplace (“Posters”). Posters accept these Terms upon submission. Anyone who responds to a listing is referred to below as an “Interested Party”; Posters and Interested Parties are collectively referred to as “Users.”
(3) The following applies to Interested Parties: they conclude contracts for listed items exclusively with the respective Poster. We check neither the accuracy of the information nor the condition, origin or legality of the items, and we are not involved in the transactions (Sections 2 and 5).
(4) Single point of contact for authorities, the European Commission and Users under Articles 11 and 12 of the Digital Services Act: hello@repaircon.de, in German or English.
2. Our role: we only provide the platform
(1) The Marketplace is a free service for the repair industry community. Posters publish offers and wanted listings there, and Interested Parties contact them directly. We charge no fees, receive no commission and earn nothing from any transaction.
(2) We are neither seller nor buyer, neither agent nor broker for any party, and we do not become a party to the contracts that Users conclude with one another. Contracts for purchase, trade or any other form of transfer are concluded exclusively between the Users involved.
(3) The initiation, conclusion and performance of these contracts, in particular price agreements, payment, invoicing, handover, transport, warranty and tax obligations, are the sole responsibility of the Users involved. We do not take part in them, do not accept payments and do not hold any items in safekeeping.
3. Participation
(1) Holders of a valid ticket or exhibitor pass for REPAIRCON26 may submit listings. When submitting, Posters must provide their ticket or order number or, if they hold an exhibitor pass, their company name instead. We verify this information during the review.
(2) After submitting, the Poster receives an email with a confirmation link. We review the listing only after it has been confirmed.
(3) Use is free of charge. There is no right to have a listing published or to use the Marketplace.
4. Permitted content and obligations of Posters
(1) The Marketplace is intended for trading used goods within the repair industry community, as an offer or a wanted listing. The focus is on used machines and equipment for refurbishing, tools, test equipment, workshop and store equipment and spare parts. New goods are permitted but are not the focus. We decide on a case-by-case basis whether a listing fits the Marketplace.
(2) The following, in particular, are not permitted:
- counterfeit goods and replicas bearing a third party's brand,
- items of unclear origin or items the Poster is not entitled to transfer,
- damaged or swollen batteries and other hazardous goods,
- content unrelated to the repair industry,
- content that violates the law or the rights of third parties.
(3) Posters must provide truthful and complete information, in particular on condition, quantity, price and price basis (net, gross, margin scheme, small business without VAT, or private sale without invoice). They may only use photos for which they hold the necessary rights. Commercial Posters are themselves responsible for complying with the statutory obligations that apply to them, for example regarding invoicing and warranty, and in the case of contracts with consumers concluded by email, by phone or at the fair outside their own business premises (for example regarding the right of withdrawal).
(4) Devices with data storage, such as POS systems, workshop PCs or diagnostic equipment, must be cleared of personal data and access credentials before handover.
(5) For the duration of the listing, Posters grant us, free of charge, the non-exclusive right to make texts and photos publicly available on the Marketplace and to adapt them technically for this purpose, for example by resizing or cropping them.
(6) Posters must write the title and description in German or English.
5. Review, rejection and removal
(1) Before approval, we only check whether a listing fits the Marketplace, is complete, comes from a person eligible to participate and does not obviously violate these Terms. We do not check the accuracy of the information or the condition, origin and legality of the items offered. Listings remain the Posters' content; we do not adopt them as our own. Reviews and decisions under this Section are made by our team; we do not use automated decision-making.
(2) We may reject, block or remove listings if they violate these Terms or statutory provisions or if there are specific indications that they do. We notify the Poster of our decision by email, together with the type and, where applicable, the duration of the measure, the reason and the rule concerned (for illegal content, also the legal basis), and a notice that the Poster may object at hello@repaircon.de. When we remove a listing or the content is illegal, we also describe the specific facts; when we reject a listing for other reasons, we add them where the reason alone does not make them clear. This does not affect the right to take legal action.
(3) We accept reports of listings that are illegal or not permitted via “Report listing” or at hello@repaircon.de. A report should identify the listing precisely and explain why it is illegal or not permitted. We confirm receipt, review every report promptly and inform the person who submitted it of our decision, provided they have given a way to contact them, together with a notice that they may object at hello@repaircon.de. This does not affect the right to take legal action.
6. Duration, reservation and deletion
(1) Listings remain online until November 14, 2026, at the latest and are removed automatically after that date.
(2) Posters can mark their listing as reserved, make it available again or delete it at any time using the links in the “Your listing is online” email. These links must be kept confidential.
(3) We may change or interrupt the Marketplace, or discontinue it early, for objective reasons, in particular in the event of technical problems, for security or legal reasons, or if REPAIRCON26 is canceled or moved. We will inform Posters of any early discontinuation by email. Except at the Poster's request, we remove individual listings only in accordance with Section 5(2). There is no right to uninterrupted availability.
7. Public information
After approval, the listing with photos, location and the Poster's name or company is visible to all visitors to the website. Posters choose which contact details (email address, phone number) are shown in addition. They become visible when someone clicks “Show contact details” and can be used by third parties to make contact. How third parties use this data is beyond our control. Details can be found in our privacy policy.
8. Items at the fair
(1) Anyone who brings items to REPAIRCON26 is responsible for them. We do not take custody of, store or insure items brought along.
(2) The Marketplace does not include a sales booth or exhibition space; items brought along will not be exhibited. Users arrange transport, pickup and handover themselves. At the venue, the hotel's right to control the premises (Hausrecht) and our own right as the organizer apply; instructions from our staff must be followed.
9. Liability
(1) Listings are the Posters' content. Claims arising from contracts between Users, for example due to defects, payment, handover or transport, exist only between the Users involved and not against us, because we are not a party to those contracts (Section 2).
(2) In cases of slight negligence, we are liable only if we breach a material obligation whose fulfillment makes the proper use of the Marketplace possible in the first place and on whose observance Posters may regularly rely. In this case, our liability is limited to the foreseeable damage that typically occurs. Otherwise, our liability for slight negligence is excluded.
(3) The limitations of liability in these Terms, including in Section 8(1), do not apply in cases of intent or gross negligence, injury to life, body or health, fraudulently concealed defects, or where we are subject to mandatory liability under the German Product Liability Act (Produkthaftungsgesetz) or for other reasons.
(4) These provisions also apply for the benefit of our legal representatives, employees and vicarious agents.
10. Indemnification
Posters indemnify us against claims asserted against us by third parties due to an infringement of their rights by the listing or due to a breach of Section 4 by the Poster, including the necessary costs of legal defense at the statutory rates. This does not apply to the extent that the Poster is not responsible for the infringement. We will inform the Poster of any such claims without undue delay, give the Poster the opportunity to comment and will not acknowledge the claims without the Poster's consent.
11. Final provisions
(1) The laws of the Federal Republic of Germany apply. With respect to consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence.
(2) If the Poster is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered office in Eberbach.
(3) Changes to these Terms apply to listings submitted after the change.
(4) If individual provisions are invalid, the remaining provisions remain valid. The statutory provisions apply in place of the invalid provision.
